Independent expert advice can help you make the right business decisions

The Pubs Code recognises the importance of independent professional advice when taking on and running a tied pub.
The Pubs Code places particular duties on the pub company when negotiating with a prospective tenant, when in rent negotiations, before agreeing to an assignment, and when agreeing a MRO investment exception, to ensure that the tenant is properly advised. Where can I get professional advice?
You should think very carefully about getting the right expert advice before making important business decisions. It is up to you who you approach for independent professional advice. However, you should be confident that your adviser is an expert in Pubs Code matters and can advise you on your rights as a tied tenant. You should consider how much experience they have of the tied pub trade to be able to help you with your business planning, rent negotiations and understanding your obligations under your agreement.

Professional advisers
It can be confusing to know where to look for professional advice about the Pubs Code and major lifecycle events in your tenancy, such as agreements, investment and business plans. Trade bodies can be a useful starting point.
- The British Institute of Innkeeping (BII) has expert helplines which offer tied tenants 30 minutes of free advice from industry and business professionals. The BII also has networks of independent accredited accountants, chartered surveyors (valuers) and solicitors who offer expert advice for tenants at all stages of their pub journey. Again, a 30-minute introductory call is available to members. All six regulated pub companies – Admiral, Greene King, Marston’s, Punch Pubs, Star Pubs, and Stonegate – take out BII membership which covers their tied tenants on substantive agreements and those negotiating for a tenancy.
- Industry trade body UKHospitality has a wealth of resources for licensees from which multiple operators in particular can benefit. Its supplier directory includes professional advisers such as specialist solicitors. UKH also offers a legal advice helpline which its members can access when needed.
- Tied tenants may also be members of other trade bodies which they can approach.

Other sources of help and support
- The The Licensed Trade Charity (LTC) has been part of the pubs industry for more than 200 years. Combining practical advice and support with a reassuring ear. The LTC runs a 24/7 helpline to provide emotional and practical support for those struggling with their wellbeing. A much-needed lifeline for some, and available to anyone working in licensed hospitality. Licensees can also receive financial support through grants.
- While Pubs Independent Rent Review Scheme (PIRRS) provides a low cost means of resolving rent disputes, available to use if both the pub company and tenant agree. Find out more on The Pub Governing Body's website.
